Default Repainted Lamborghini

I recently agreed to purchase a lamborghini from an independent dealer not affiliated with this site. When I went to pick up the car that had been described to me as having no paintwork (all origianl paint) I found out most of the car had been repainted, (not heavy body work, the car has a clean car fax) but still it was repainted some of it extremely well, some of it not so well. My two questions for this board
A) Was I obligated to buy the car even though it was described wrong?
B) How much does paintwork decrease the value of a Ferrari or lamborghini?
Opinions?

Well, it depends on how the contingency clause was worded in the contract. Take this as friendly advice, not legal advice (still deciding on whether or not to go to law school). The contingency will usually say something like "The vehicle has been described to the best of our ability, and we shall make no guarantees to the condition of the vehicle henceforth." This covers their rear. And if the Carfax was clean, you would need to take it to a shop and have them submit a document that it does show non-factory paintwork - in their opinion. In other words, you're screwed. But, look on the bright side, most whom are serious about these cars know that stuff happens, and as long as the car hasn't been badly twisted, then you don't have a lot to worry about with resale. I think the only people whom this matters to are F-car snobs. Besides, even if it did make a difference in resale, then you would probably spend more in a legal battle than the resale difference, unless you represented yourself in small claims.

HELL No you don't have to buy it and you don't need a lesson in legalese either..... No offense Bull. Pure and simple if the car is not as described, walk away...Or grind them on the price if it doesn't bother you. Just paint work shouldn't make much difference to the value so long as there's been no damage, and you don't know that either...Not everything ends up on carfax.

Another thing, is if it's a newer car a so so paint job will kill the value. Older models are expected not to be perfect.

I would appreciate it if you could send me a PM with the name of the dealer, so that I can avoid them and the car as well. I am currently looking myself. Thanks.

In Florida, I do not believe you would be obligated to purchase a car that had been misrepresented. These are classic cars and the repainting issue can greatly impact values. Representations that are inaccurate or deceptive would be grounds for withdrawing your offer. WJGESQ

I'd like to see the Dealer that would force you to buy a car. The worst they could do is take you to court and try and get some penalty for backing out, which would be ridiculous, and only if you signed something. Give me a break.

What Year Car Is It? Mileage, etc. I Own A Collision Shop And Don't Think Some Paint Work Makes A Bad Car, Have It Inspected By A Collision Repairer With Experience In Exotic Cars.
Possibly Neg A Better Price?

Point taken. I made the assumption he had signed a contract already. I should have stuck with the adage: To Assume makes an A** of U and ME
