If the cop wrote both of you up, you may have a way out of paying taxes. It depends on the circumstances of the situation, and it does work, as I have done this on numerous occassions when I fell into this scenario.
If he was using a handheld radar/laser ect. that is capable of precise aiming by the operator, then you are going to pay. If it was a unit mounted in his patrol car then you can whip his ass quite easily.
Just to clarify, I work on radar/laser speed detecting devices in my job (not law enforcement related) . Tune them, calibrate them, and repair them.
So, here is the deal. If it was a hard mounted unit in a patrol car, it CAN NOT determine the specific vehicle it is alarming on. It is up to the officer to determine visually which vehicle is causing the alarm. His unit locked onto one of you and gave him a fairly accurate sppeed reading, but the problem is that he has no way of knowing which of you it was unless it was extremely obvious to him. In other words, one is traveling so much faster than everyone else that it is very obvious as to which vehicle is the fastest.
Your defense is comprised of the fact that he wrote two citations for ONE speed registering alarm. It is impossable for him to determine both of your vehicles were breaking the speed limit with just one alarm. He HAS to determine which vehicle gave him the alarm, and if he wrote both of you up, then his credibility has gone out the door along with any proof he claims to have. He can't back up and say car A gave the alarm as car B was visually going faster than A.
Ever gone by one of those trailers parked on the side of a road with a screen that displays the speed of the cars going by it? Ever notice it is often hard to determine if the speed is you or the car ahead of you? Same thing happens when his detection system is not aimable and hard mounted in his cruiser.
I live here in Washington state also, I have been in this scenario quite a few times before. Each and every time, the courts have dismissed the citations. I do have the advantage of being able to dispaly my FCC license with radar/laser endorsements, but the case was always basically decided before I displayed my trump card.
Now, if was a cop standing beside his cruiser or bike aiming his device down the road where he has enough time to sample each and every target before the pass by him, then it will be easier to just pay him. He done got you!!!
