Default Won Lamborghini on Ebay but owner won't sell...

Gents,
On February 10th I won a Lamborghini on ebay. So far so good!
I paid the requested deposit within hours via Paypal. The ebay ad listed full payment via certified check. But I requested from seller if I could pay the remaining amount via bank wire transfer for a much quicker, safer and easier payment.
Was then told by seller in writing that he should try to get his banking details for me.
I repeated my request for his banking details several times via personal ebay messages and then after 4 days I received a different return message: That I should just send a check as per the ebay ad.
So I then took time off work the day after, went to my bank, and sent the check. That was on Feb 15th.
Now he says the auction is void due to not having received my full payment! He said he also has other interested buyers, probably willing to pay more! He said he would put it back on ebay tomorrow!

My ebay feedback is 100% and I really try doing all my business and ebay transaction as smooth and easy for both parties. I have bought other cars on ebay and have had no problems with the sellers at all.

What are my options here?
Can he void or cancel the deal?
I have notified Ebay, so they are looking at it.

Would appreciate any info from other ebayers, maybe with similar experiences! Thanks!

Cheers,
Bjoern

In normal world, not Ebay world, seller can deside not to sell as long as you do not have car papers/singn deal in real paper.

Personally I use plastic... Plastic bag with cash in it, in my experience that is most reliable. One time I bought F-car and waited 6 days in hotel just waiting German bank to transfer my money. Only after I stated that bank has lost my money in loud noise in bank hall, suddenly money was found...
National bank/central bank/local banks like to hold money going trough it, in that time it can invest it and large banks has huge mount of money "going trough" and it is stedy flow to use as they like.

You should contact Paypal as well. They may be able to help out. Please PM me the seller's name or a link to the car if it is relisted. I am looking as well and I sure don't want deal with a jerk like that. Thanks.

The seller responded on Fchat. Sounds like the terms were not met by you, and therefore the auction will begin again.

It seems that he was hoping for the bidding to go much higher which it didnt and you ended up snatching a good deal. Only advice i can give is save ALL the proof you have to support your claim. Goodluck and sorry to hear this.

Is he withholding your deposit? He can't do that if you are willing to complete the deal.

This issue has been re-solved...I stepped and and worked with both parties and took care of the paperwork and trasaction for free...they are both happy and the car is secured now.

Just wanted to help out two fellow Lambo lovers..

Happy ending.

Wow that's great. I was reading this because I am an early shopper and just wanted to do some research. I was initially interested in an 360, but saw some Gallardos and became interested in these.

Im in the same boat, kind of. I'm about 8-12 months from being able to pull the trigger. But I was/am looking at 360 CS's but the '08 Superleggera's have really caught my eye.

I recently joined this site and it's great to see a resolution as provided by roytoy.
